Terms and Conditions
TruckTechGuru – Remote ECM Programming and Tuning Services
Effective Date: 01.10.2024
These Terms and Conditions (“Agreement”) govern all remote ECM programming, tuning, and related services (“Services”) provided by TruckTechGuru (“Provider”) to any customer or entity (“Customer”). By purchasing or using any of these Services, the Customer agrees to the following terms:
⸻
1. Legal Use and Jurisdiction
The legality of ECM tuning, emission modifications, or related software changes depends on the country, region, or state in which the vehicle is operated.
The Customer is solely responsible for ensuring that any modifications comply with the laws and regulations of their location.
TruckTechGuru assumes no responsibility or liability for how or where the tuned vehicle is used. All Services are provided “as-is” for off-road, competition, or export use only.
⸻
2. Scope of Work
The Provider offers remote ECM programming, tuning, and related technical services for heavy-duty trucks and engines.
All Services are performed remotely, based on information and data provided by the Customer. The Provider is not responsible for inaccuracies or issues resulting from incomplete or incorrect information provided by the Customer.
⸻
3. Test Drive and Post-Service Reporting
After programming or tuning, the Customer must perform a minimum 50-mile test drive to confirm proper functionality.
If any issues arise, the Customer must report them immediately and return for adjustments or troubleshooting.
Failure to do so, or seeking assistance from third parties before notifying the Provider, voids any support or responsibility from TruckTechGuru.
⸻
4. No Warranty and Limited Liability
All Services are provided without any express or implied warranties, including but not limited to performance, reliability, or compliance with emissions standards.
The Customer accepts full responsibility for the outcome of the tuning and for any potential engine, drivetrain, or electronic system issues that may occur.
TruckTechGuru’s total liability shall in no case exceed the amount paid by the Customer for the specific service provided.
⸻
5. No Refund Policy
Due to the nature of digital and customized ECM programming, all sales are final.
Once programming has been completed or software files have been sent, no refunds or chargebacks will be accepted under any circumstances.
⸻
6. Customer Responsibilities
The Customer must:
• Provide accurate and complete vehicle data before programming.
• Follow all post-programming instructions provided by the Provider.
• Ensure that all mechanical systems of the vehicle are in proper condition before tuning.
• Not share or distribute any software or files received from the Provider.
Failure to comply with these conditions may result in cancellation of further support and denial of future services.
⸻
7. Confidentiality and Intellectual Property
All tuning files, software, and configurations provided by TruckTechGuru remain the intellectual property of the Provider.
The Customer receives a non-transferable, non-exclusive license to use these files only on the specified vehicle.
Reproduction, resale, or distribution of any materials is strictly prohibited.
⸻
8. Indemnification
The Customer agrees to indemnify and hold harmless TruckTechGuru and its representatives from any claims, damages, legal actions, or financial losses arising from the use or misuse of the tuned vehicle or software.
⸻
9. Agreement and Acceptance
By using TruckTechGuru’s Services, the Customer confirms that they:
• Have read and understood this Agreement.
• Accept all associated risks.
• Agree that all modifications are for off-road or export use only.
